1. About Vexel Create

Vexel Create (the "Platform", "we") is an online service that uses artificial intelligence to generate images, videos, audio and marketing copy for products, including avatars and virtual influencers. By creating an account or using the Platform, you agree to these Terms of Use and to our Privacy Policy.

2. Account and signup

You must give true information when signing up and keep your password confidential. The account is personal and non-transferable. You are responsible for all activity carried out with your access. You must be 18 or older (or have your legal guardian's authorisation) to use the Platform.

3. Credits and payments

Generations consume credits, made available according to the plan you subscribe to. Credits bought in packs do not expire; promotional or subscription credits may have an expiry stated at the time of the offer. If a generation fails because of a Platform error, the credits are refunded automatically. Credits are not refundable in cash and cannot be transferred between accounts, except where the law requires it. The 7-day right of withdrawal under the Brazilian Consumer Protection Code applies only to purchases that are still unused: from the moment you use any credit from the purchase, the service is considered started and consumed, and the amount paid is no longer refundable.

4. Generated content and ownership

The content you generate on the Platform (images, videos, audio and scripts) is yours: you receive all commercial use rights over the result, to the extent permitted by applicable law. The material you upload (product photos, references) remains yours; you grant us a limited licence to process it solely in order to run the generations you request. The gallery avatars, the brand, the website and the Platform technology belong to Vexel Create.

5. Responsible use

You may not use the Platform to:

• create content using the likeness of real people without their authorisation (including deepfakes of third parties);
• create content using the likeness of politicians, candidates, public officials or celebrities, or any electoral propaganda or content that may mislead about real facts or people;
• create illegal, defamatory or discriminatory content, sexually explicit content involving minors, or content that infringes the rights of third parties (trademarks, copyright, likeness);
• create misleading advertising or consumer fraud;
• attempt to bypass the technical, security or billing limits of the Platform.

Accounts that break these rules may be suspended or closed, without prejudice to any applicable legal measures. You are solely responsible for the use you make of the generated content, including compliance with the rules of the platforms where you publish it (such as TikTok) and with applicable advertising regulations — we recommend disclosing when content is AI-generated.

To enforce these rules, images sent to some tools are analysed automatically before generation. A blocked generation is reviewed by our team, who may release or reject it; on rejection the credits are returned and the account may be blocked. We keep a record of who generated each piece of content and provide it to the authorities when required by law.

6. Availability and limitations

The Platform uses third-party artificial intelligence models; results may vary and we do not guarantee that a specific generation will meet a particular aesthetic expectation. We may change features, credit prices and the models used in order to maintain and evolve the service. We make reasonable efforts to keep the service available, without any guarantee of uninterrupted operation. To the maximum extent permitted by law, our total liability is limited to the amount you paid in the 12 months before the event.

7. Termination

You may close your account at any time. We may suspend or close accounts that break these Terms. If an account is closed, your generated content remains available for download for 30 days, except in the case of a serious breach of these Terms.

8. Changes and contact

We may update these Terms; relevant changes will be announced on the Platform. Continued use after an update means you agree to it. Questions: contato@vexelcreate.com. These Terms are governed by the laws of Brazil, with jurisdiction in the consumer's district where applicable.
